Vulnerability, understood as a negative aspect of criminalization under immune considerations, constitutes itself as a creative and transformative force that makes it possible to think about a life in common sustained through care and affirmative protection of life. The development of this idea requires three specific stages: in the first, it is described the current democracy as a government technique whose management depends on vulnerable populations; in the second, it is reviewed criminalization as a specific form of immune control; and (...) finally, it is recognized vulnerability as the basis of a new way of democratic life, departing from the attention of certain social groups that have been criminalized due to their precariousness. Modernity brought with it the insistence on these ideas and the divorce of science and faith does not seem to stop. En efecto, la pregunta (...) por el ser humano, y sus consideraciones hacia la fe religiosa pasan a ser el eje central de su predicación anglicana. Este artículo muestra, bajo un estudio estadístico-heurístico, la centralidad temática de la predicación anglicana de Newman que acontece entre 1824 y 1843. The question of religious faith and its possibilities in the modern world supposes a particular understanding of being human. Indeed, depending on how man understands himself will influence how he recognizes his possibilities of a believing experience, and openness to this as a possible and plausible reality. This is what Cardinal John Henry Newman understood very well, from the beginning of his ministry. Undoubtedly, the question on being human and his considerations on religious faith became the centerpiece of his Anglican preaching. Modernity is founded on the belief that the world we build is a human invention, not a part of nature. The ecological consequences of this idea have been catastrophic. We have laid waste to natural ecosystems, replacing them with fundamentally unsustainable human designs. The philosopher Henry Richardson's short book is a defense of a position on a neglected topic in medical research ethics. Clinical research ethics has been a longstanding area of study, dating back to the aftermath of the Nazi death-camp doctors and the Tuskegee syphilis study. Most ethical regulations and institutions have developed in response to those past abuses, including the stress on obtaining informed consent from the subject. Richardson points out that that these ethical regulations do not address one (...) of the key dilemmas faced by medical researchers -- whether or not they have obligations towards subjects who need care not directly related to the purpose of the study, termed 'ancillary care obligation'. Background: Moral distress occurs when constraints prevent healthcare providers from acting in accordance with their core moral values to provide good patient care. The experience of moral distress in nurses might be magnified during the current Covid-19 pandemic. Objective: To explore causes of moral distress in nurses caring for Covid-19 patients and identify strategies to enhance their moral resiliency. Research design: A qualitative study using a qualitative content analysis of focus group discussions and in-depth interviews. We purposively sampled 31 nurses (...) caring for Covid-19 patients in the acute care units within large academic medical systems in Maryland and New York City during April to June 2020. Ethical considerations: We obtained approval from the Institutional Review Board at the University of Maryland, Baltimore. Results: We identified themes and sub-themes representative of major causes of moral distress in nurses caring Covid-19 patients. These included (a) lack of knowledge and uncertainty regarding how to treat a new illness; (b) being overwhelmed by the depth and breadth of the Covid-19 illness; (c) fear of exposure to the virus leading to suboptimal care; (d) adopting a team model of nursing care that caused intra-professional tensions and miscommunications; (e) policies to reduce viral transmission (visitation policy and PPE policy) that prevented nurses to assume their caring role; (f) practicing within crisis standards of care; and (g) dealing with medical resource scarcity. Participants discussed their coping mechanisms and suggested future strategies. Discussion/Conclusion: Our study affirms new causes of moral distress related to the Covid-19 pandemic. Institutions need to develop a supportive ethical climate that can restore nurses’ moral resiliency. Such a climate should include non-hierarchical interdisciplinary spaces where all providers can meet together as moral peers to discuss their experiences. (shrink)

This paper takes up Berman and Hafner's (1993) challenge to model legal case-based reasoning not just in terms of factual similarities and differences but also in terms of the values that are at stake. The formal framework of Prakken and Sartor (1998) is applied to examples of case-based reasoning involving values, and a method for formalising such examples is proposed. The method makes it possible to express that a case should be decided in a certain way because that advances certain (...) values. The method also supports the comparison of conflicting precedents in terms of values, and it supports debates on the relevance of distinctions in terms of values. (shrink)

Resolution of the problem of mass nouns depends on an expansion of our semantic/ontological taxonomy. Semantically, mass nouns are neither singular nor plural; they apply to neither just one object, nor to many objects, at a time. But their deepest kinship links them to the plural. A plural phrase — 'the cats in Kingston' — does not denote a single plural thing, but merely many distinct things. Just so, 'the water in the lake' does not denote a single aggregate — (...) it is not ONE, but rather MUCH. The world is not the totality of singular objects, plural objects, and mass objects; for there are no plural or mass objects. It is the totality of single objects and (just) stuff. (shrink)

ABSTRACT As well as the mathematically-supported celestial mechanics that Newton developed in his Principia, Newton also proposed a more speculative natural philosophy of interparticulate forces of attraction and repulsion. Although this speculative philosophy was not made public before the ‘Queries’ which Newton appended to the Opticks, it originated far earlier in Newton’s career. This article makes the case that Newton’s short, unfinished manuscript, entitled ‘De Aere et Aethere’, should be seen as an important landmark in Newton’s intellectual development, being the (...) first work in which Newton assumed there are repulsive forces operating at a distance between the particles of bodies. The article offers an account of how Newton came to write ‘De Aere et Aethere’ and why. It also outlines its relationship to the ‘Conclusio’, with which Newton briefly intended to finish the Principia, and to the ‘Queries’ in the Opticks. The date of the manuscript is disputed, and the article also aims to settle this dispute. Claims that the ‘De Aere et Aethere’ must have been written before the ‘Hypothesis... of Light’ of 1675 are dismissed, and it is suggested, following R. S. Westfall, that it was written after a well-known letter Newton wrote to Boyle early in 1679. (shrink)

Henry Home (1696-1782) has been called "perhaps the most complete 'Enlightenment man' among the eighteenth-century Scottish thinkers." Kinsman and friend of David Hume, mentor and patron of Adam Smith, John Millar, and Thomas Reid, he was a key figure in that circle of luminaries. He read law, was called to the bar in 1723, was raised to the Bench of the Court of Session in 1752, with the title Lord Kames (the name of his family estate), and joined the (...) High Court of the Justiciary in 1763. Publishing broadly in law, history, philosophy, and criticism, Kames made significant contributions to the Enlightenment's science of human nature. The Essays is commonly considered Kames's most important philosophical work. In the first part, he sets forth the principles and foundations of morality and justice, attacking Hume's moral skepticism and addressing the controversial issue of the freedom of human will. In the second part, Kames focuses on questions of metaphysics and epistemology to offer a natural theology in which the authority of the external senses is an important basis for belief in the Deity. The text of this volume is based on the third edition of 1779, while the appendix presents substantial variant readings in the first and second editions. (shrink)

This book posits that a sustainable future is possible without abandoning Capitalism. In its present form as Consumer Capitalism, the organization of the global economy is clearly unsustainable. But Capitalism is a malleable concept that has assumed a variety of forms since the 17th Century, and it can be altered as needed. In Part I of this book, Wayne Henry sets out an economic model for a sustainable form of Capitalism, referred to in the literature as Natural Capitalism. In (...) Part II, he abandons exposition in favour of rigorous philosophical analysis and critiques the older but still dominant narrative that underlies Classical Liberalism. The narrative will be reconstructed with great care and analyzed to understand why it has been so powerful and enduring, and, of course, why it is no longer appropriate for our present circumstances. In Part III, he investigates Classical Liberalism and globalized capitalism, the economic system it licenses, from a normative perspective. Finally, in the conclusion, Henry draws the threads of the discussion together in a way that emphasizes the differences between the two narratives, Classical Liberalism on the one hand, and the contemporary version of Progressive Liberalism that nurtures and supports Natural Capitalism on the other. This book will be of interest to a broad range of scholars and curious laypersons interested in a clear and interdisciplinary presentation of the issues arising out of climate change, including corporate governance, social and environmental policy, declining social capital and the capacity of democratic institutions to deal effectively with sustainability. Interdisciplinary work is intractable because the search for knowledge in different fields entails different interests, and thereby different values too; and the different possibilities of knowledge about different subjects also lead to different epistemologies. Thus differ ences among practitioners of the various disciplines are pervasive and aptly described as cultural ones, and interdisciplinary work requires transcending unconscious habits of thought. The more those unconscious habits are explicated and the more we under stand how the disparate characteristics of the various intellectual (...) cultures are related to the necessarily different interests, values, and epistemologies, the more feasible becomes the goal of transcending thought habits. Two sorts of interdisciplinary effort seem to have been successful: specific, delimited problems have been solved by teams in what is actually multidisciplinary rather than interdisciplinary work, and new disciplines have sprung up at the intersections of existing ones. STS fits neither of those patterns. Can it nevertheless be viable? (shrink)

Samuel Clarke is best known to historians of science for presenting Isaac Newton’s views to a wider audience, especially in his famous correspondence with G. W. Leibniz. Clarke’s independent writings, however, reveal positions that do not derive from, and do not coincide with, Newton’s. This essay compares Clarke’s and Newton’s ideas on the cause of gravity, with a view to clarifying our understanding of Newton’s views. There is evidence to suggest that Newton believed God was directly responsible for gravity, and (...) this interpretation has been promoted by a number of scholars. By comparing Newton’s views with those of Clarke, however, it can be seen that Newton did not subscribe to the kind of occasionalist approach to gravity that Clarke developed. Clarke insisted that matter was categorically incapable of being endowed with powers or forces and that therefore what looks like gravitational attraction has to be performed directly by God or by angels. By comparing Clarke’s pronouncements with Newton’s, it becomes clear that Newton adopted the more standard line: that the first cause, God, operated in nature through secondary causes and that gravitational attraction was just such a secondary (albeit occult) cause. Decisions concerning proof of facts in criminal law must be rational because of what is at stake, but the decision‐making process must also be cognitively feasible because of cognitive limitations, and it must obey the relevant legal–procedural constraints. In this topic three approaches to rational reasoning about evidence in criminal law are compared in light of these demands: arguments, probabilities, and scenarios. This is done in six case studies in which different authors analyze a manslaughter case from different theoretical perspectives, (...) plus four commentaries on these case studies. The aim of this topic is to obtain more insight into how the different approaches can be applied in a legal context. This will advance the discussion on rational reasoning about evidence in law and will contribute more widely to cognitive science on a number of topics, including the value of probabilistic accounts of cognition and the problem of dealing with cognitive biases in reasoning under uncertainty in practical contexts. In his Metrica, Hero provides four procedures for finding the area of a circular segment (with b the base of the segment and h its height): an Ancient method for when the segment is smaller than a semicircle, $$(b + h)/2 \, \cdot \, h$$ ( b + h ) / 2 · h ; a Revision, $$(b + h)/2 \, \cdot \, h + (b/2)^{2} /14$$ ( b + h ) / 2 · h + ( b / 2 (...) ) 2 / 14 ; a quasi-Archimedean method (said to be inspired by the quadrature of the parabola) for cases where b is more than triple h, $${\raise0.5ex\hbox{$\scriptstyle 4$} \kern-0.1em/\kern-0.15em \lower0.25ex\hbox{$\scriptstyle 3$}}(h \, \cdot \, b/2)$$ 4 / 3 ( h · b / 2 ) ; and a method of Subtraction using the Revised method, for when it is larger than a semicircle. He gives superficial arguments that the Ancient method presumes $$\pi = 3$$ π = 3 and the Revision, $$\pi = {\raise0.5ex\hbox{$\scriptstyle {22}$} \kern-0.1em/\kern-0.15em \lower0.25ex\hbox{$\scriptstyle 7$}}$$ π = 22 / 7. We are left with many questions. How ancient is the Ancient? Why did anyone think it worked? Why would anyone revise it in just this way? In addition, why did Hero think the Revised method did not work when $$b > 3\;h$$ b > 3 h? I show that a fifth century BCE Uruk tablet employs the Ancient method, but possibly with very strange consequences, and that a Ptolemaic Egyptian papyrus that checks this method by comparing the area of a circle calculated from the sum of a regular inscribed polygon and the areas of the segments on its sides as determined by the Ancient method with the area of the circle as calculated from its diameter correctly sees that the calculations do not quite gel in the case of a triangle but do in the case of a square. Both traditions probably could also calculate the area of a segment on an inscribed regular polygon by subtracting the area of the polygon from the area of the circle and dividing by the number of sides of the polygon. I then derive two theorems about pairs of segments, that the reviser of the Ancient method should have known, that explain each method, why they work when they do and do not when they do not, and which lead to a curious generalization of the Revised method. Hero’s comment is right, but not for the reasons he gives. I conclude with an exploration of Hero’s restrictions of the Revised method and Hero’s two alternative methods. (shrink)

The survival of neoliberal forms of governance after their apparent repudiation during the Global Financial Crisis is a problem that continues to generate significant scholarly controversy. One of the most influential accounts of the survival of neoliberalism in the crisis draws on Michel Foucault’s The Birth of Biopolitics to claim that states intervening to support financial markets during the crisis was simply the neoliberal system working as expected. Returning to Foucault’s original text, I argue this account constitutes a systematic misreading (...) because it treats Foucault as having developed an instrumentalist theory of the neoliberal state, a possibility Foucault explicitly rejected. I suggest that the reasons that led Foucault to reject an instrumentalist theory of the state remain just as relevant today, and accordingly argue for a return to Foucault’s methodological decision to treat neoliberalism not as a theory of state but as a discourse which constructs a novel bio-political governmentality. Henry Sidgwick (1838-1900), English philosopher and educator is today most famous for his Methods of Ethics first published in 1874 and considered by C. D. Broad among others to be the greatest single work on ethics in English. Besides philosophy, Sidgwick wrote on education, literature, political theory, the history of political institutions, and psychical research. He was also active in University politics, economics and administration, playing a large part in the founding of the first College for women - Newnham (...) College, Cambridge. Although Methods of Ethics is considered the most valuable of his writings - reprinted here in its first and last editions - his intellect is displayed in the full extent of his writings. Professor Marshall said in reference to his discussions of the proper functions of government in Principles of Political Economy that it was 'by far the best thing of the kind in any language'. In all his writings, Sidgwick is rigorous and cautious, reluctant to advance ideas without making sure of his ground. In common with Mill he was opposed to mystical and transcendental methods. This comprehensive collection brings together the most definitive editions of all his books and includes the standard biography written by his wife, as well as two volumes of previously uncollected essays and reviews. This book investigates modern global civilization, offering an alternative to post-colonial theories and the "multiple modernities" approach (as well as the civilizational theory linked to it). It argues that modernity has become a global civilization that is heterogeneous and intertwined with other civilizations, and also aims at a renewal of critical theory that is not US-centric and Eurocentric, focusing instead on China, South Asia (India) and Latin America (Brazil). Dealing with the themes of centre-periphery relations, complexity (including culture and religion), (...) democracy and emancipatory possibilities, this book is based on general theoretical ideas such as collective subjectivity, the interplay of memory and creativity, and the concept of "modernizing moves," so as to deal with historical contingency. In recent years biomimicry has emerged as a powerful response to the problem of sustainability and today exerts an important influence on both architecture and urbanism. The implications of this trend for the humanities have, however, been largely overlooked. Taking a historical approach, the first key argument of this article is that throughout Western history the dominant model for the polis, qua both city and State, has been the human being and that it was also this basic model that underlay (...) traditional understandings of the place of humans in cities and States. With the transition to biomimetic cities and States, the key model of which is the forest ecosystem, the question of the place of humans arises once again. In response to this question, the article proposes a speculative philosophical anthropology based on a combination of Heidegger’s thinking of the clearing and recent insights from the study of human evolution and pre-history with a view to grounding a new model of the polis not simply on the forest, but rather on the forest and the clearing. This text aims at pointing out some of the philosophy of law present in the works of the Hellenist philosopher and physician Sextus Empiricus (ΣΕΞΤΟϒ ΕΜΠΕΙΡΙΚΟϒ), and supports two main theses: the first, based on an epistemological point of view, presupposes that exact knowledge of the world — that is, an entirely adequate relationship between the mind of each human being and the events around — is not possible, which insurmountably renders all perception relative. The second thesis, from an axiological (...) point of view, postulates that Skepticism does not necessarily imply disregarding concepts of justice or abandoning any ethical parameters, but functions as an immunizing element against intolerance and dogmatism. A Lacanian approach to murder scene investigation. What if Jacques Lacan—the brilliant and eccentric Parisian psychoanalyst—had worked as a police detective, applying his theories to solve crimes? This may conjure up a mental film clip starring Peter Sellers in a trench coat, but in Lacan at the Scene, Henry Bond makes a serious and provocative claim: that apparently impenetrable events of violent death can be more effectively unraveled with Lacan's theory of psychoanalysis than with elaborate, technologically advanced forensic tools. (...) Bond's exposition on murder expands and develops a resolutely Žižekian approach. Seeking out radical and unexpected readings, Bond unpacks his material utilizing Lacan's neurosis-psychosis-perversion grid. Bond places Lacan at the crime scene and builds his argument through a series of archival crime scene photographs from the 1950s—the period when Lacan was developing his influential theories. It is not the horror of the ravished and mutilated corpses that draws his attention; instead, he interrogates seemingly minor details from the everyday, isolating and rephotographing what at first seems insignificant: a single high heeled shoe on a kitchen table, for example, or carefully folded clothes placed over a chair. From these mundane details he carefully builds a robust and comprehensive manual for Lacanian crime investigation that can stand beside the FBI's standard-issue Crime Classification Manual. (shrink)
